This policy (the "Policy") applies to the Tanaqul Precious platform on the web (investor.tanaqul.app), its mobile and tablet version, Tanaqul Explorer (explorer.tanaqul.app), and related services (collectively, the "Services"), and explains how Exit Finance, CR 1010843884, registered with the Ministry of Commerce ("Exit Finance" or "we"), handles notices of copyright infringement and how you ("you") can submit a complaint about such infringement.
The protection of intellectual property is of the utmost importance to us, and we ask our users and their authorised agents to do the same. It is our policy to respond promptly to clear notices of copyright infringement that comply with the laws applicable in the Kingdom of Saudi Arabia concerning the protection of intellectual property (the "Law"), which can be consulted on the website of the Saudi Authority for Intellectual Property.
What to consider before submitting a copyright complaint
Before submitting a copyright complaint to us, consider whether the use could be considered fair use. The fair use rules provide that, in certain circumstances, short excerpts of copyrighted material may be quoted verbatim for purposes such as criticism, news reporting, teaching and research, without the need for permission from, or payment to, the copyright holder. If you have considered fair use and still wish to submit a copyright complaint, submit it to us in accordance with this Policy.
Please note that under Saudi law you may be liable for any damages, including costs and attorneys' fees incurred by us or by users, if you knowingly claim that material or activity is infringing. If you are not sure whether the material you are reporting is in fact infringing, you may wish to contact a lawyer before submitting a notice to us.
We may, at our discretion or as required by law, share a copy of your notice or counter-notice with third parties. This may include sharing the information with the account holder involved in the allegedly infringing activity, or for publication. If you are concerned about your information being forwarded, you may wish to appoint an agent to report infringing material for you.
Infringement notices
If you are a copyright owner or an agent of one, and you believe that any material available on our Services infringes your copyright, you can submit a written notice of copyright infringement (the "Notice") by sending it to Policy@exit.sa in accordance with the Law, including the following information:
- Identification of the copyrighted work that you claim has been infringed or, if this Notice covers multiple copyrighted works, you may provide a representative list of the copyrighted works that you claim have been infringed.
- Identification of the infringing material and the information that you claim is infringing (or the subject of the infringing activity), including at a minimum, where appropriate, the page address (URL) or the name of the screen in the platform where the allegedly infringing material is located.
- Information reasonably sufficient to allow us to contact you, such as an address and telephone number and, if available, an email address.
- A statement that you believe in good faith that the use of the material in the manner complained of is not authorised by the copyright owner, the copyright owner's agent or the Law.
- A statement that the information in the Notice is accurate and, under penalty of the sanctions for malicious claims, that you are authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
- A physical or electronic signature (typing your full name or the name of the entity you represent will be sufficient) of the copyright owner or of the person authorised to act on their behalf.
All such notices must comply with the requirements of the Law. You may consult your lawyer or other similar services to avoid making mistakes and to ensure your Notice complies.
Submitting a formal complaint starts a predetermined legal process. Your complaint will be reviewed for accuracy, validity and completeness. If your complaint has met these requirements, our response may include removing or restricting access to the allegedly infringing material, and banning the accounts of repeat infringers, while the metals registered in their names remain their property. We may also require a court order from a competent court, as we determine in our sole discretion, before taking any action.
If we remove or restrict access to material, or ban an account, in response to a notice of alleged infringement, we will make a good-faith effort to contact the user concerned with information about the removal or restriction of access, which may include a full copy of your Notice (including your name, address, telephone number and email address).
Notwithstanding anything to the contrary in any part of this Policy, Exit Finance reserves the right not to take any action on a copyright infringement notice if it does not meet all the requirements of the Law.
Changes and amendments
We reserve the right to modify this Policy or its terms relating to the Services at any time at our discretion. When we do, we update the "Last updated" date at the top of this page. A change takes effect from the date it is published; however, we notify you of a material change within the platform before it takes effect. Your continued use of the Services after the effective date of the revised Policy (or any other act specified at that time) will constitute your consent to those changes.
